Terms of Service

1. Acceptance of Terms

By accessing or using HeroCall ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. HeroCall is currently in beta and the Service may change without notice.

HeroCall is operated by an individual based in British Columbia, Canada ("we", "us", "our"). You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service you represent that you meet this requirement and that your use is lawful where you live.

2. Description of Service

HeroCall is an AI-powered poker coaching application that provides conversational hand review and strategy analysis for No Limit Texas Hold'em cash games. The Service uses artificial intelligence to parse hand descriptions and generate strategic coaching feedback. HeroCall is an educational tool and does not guarantee improved poker results.

3. Beta Program

HeroCall is currently offered as a beta product. During the beta period, the Service is provided "as is" and may contain bugs, errors, or interruptions. We reserve the right to modify, suspend, or discontinue any aspect of the beta at any time.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) engage in any activity that interferes with or disrupts the Service; (c) attempt to gain unauthorized access to any part of the Service; (d) use automated systems to access the Service beyond normal use; or (e) share your account credentials with others.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by HeroCall and are protected by international copyright, trademark, and other intellectual property laws. Your hand data and conversations remain yours. You grant us a license to host, process, and display them to provide the Service — including, if you create a share link, publicly displaying the shared snapshot (and generating a link-preview image from it) until you revoke the link or delete the underlying conversation or your account.

7. AI-Generated Content Disclaimer

Coaching analysis provided by HeroCall is generated by artificial intelligence and is intended for educational purposes only. AI-generated advice may contain errors or inaccuracies. You should not rely solely on HeroCall's analysis for real-money poker decisions. HeroCall does not guarantee the accuracy, completeness, or usefulness of any coaching content.

8. Limitation of Liability

To the maximum extent permitted by law, HeroCall shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service. This includes any losses incurred from poker play informed by the Service's coaching.

9. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page with an updated effective date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Eligibility and Lawful Use

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. HeroCall is an educational and analytical tool only: it is not a gambling service, does not accept or facilitate wagers, and does not provide financial, legal, or gambling advice. You are solely responsible for ensuring that playing poker, and your use of this Service in connection with it, is lawful where you are located.

12. Shared Content

The Service lets you publish a hand review at a public link. Anything in the shared snapshot — the hand, your messages, the coaching responses, and the display name you optionally attach — becomes viewable by anyone with the link. You are responsible for what you share: do not include other people's personal information in content you publish, and do not share content that is unlawful, defamatory, or infringing. You can revoke a share link at any time from the app; revocation disables the link but cannot recall copies made while it was live. We may disable any shared page at our discretion.

13. Subscriptions and Refunds

If you purchase a subscription, paid plans are billed in advance on a recurring basis via our payment processor and renew automatically until canceled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds except where required by law. We will give you advance notice of price changes, which apply from your next renewal.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ANALYSIS WILL BE ACCURATE OR COMPLETE.

15. Indemnification

You agree to indemnify and hold harmless HeroCall and its operator, and any agents or contractors acting on their behalf, from any claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms, your content (including content you share publicly), or your unlawful use of the Service.

16. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service shall be resolved exclusively in the courts of the Province of British Columbia, and you consent to their jurisdiction. Nothing in this section limits any right you have under the consumer-protection laws of your place of residence.

17. General

These Terms are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control. These Terms do not create rights in any third party.
